Dickinson County Board of Supervisors

Present are
Supervisors Wayne Northey, Mardi Allen, Chairperson David Gottsche, Paul
Johnson and Pam Jordan.
The Board of
Supervisors then proceeded to discuss the matter of calling a special County election.
Board Member Paul
Johnson introduced the following Resolution entitled “RESOLUTION CALLING A
SPECIAL COUNTY ELECTION,” and moved its adoption. Board Member Mardi Allen seconded the motion to adopt. The roll was called and the vote was,
AYES: Wayne Northey, Mardi Allen, David
Gottsche, Paul Johnson and Pam Jordan.
Whereupon, the Chairperson declared the following Resolution duly
adopted:
RESOLUTION CALLING A SPECIAL COUNTY
ELECTION.
WHEREAS,
the County of Dickinson, State of Iowa, proposes to contract indebtedness and
issue general obligation bonds to provide funds to pay costs of a general
county purpose project hereinafter described; and
WHEREAS, Section 331.442 of the Code of
Iowa, provides that before the Board may institute proceedings for the issuance
of bonds for a general county purpose, it shall call a special County election
to vote upon the proposition of issuing said bonds in accordance with the
provisions of said statute; and
WHEREAS, neither the proposal for the
issuance of the bonds hereinafter set forth, nor any other proposal
incorporating any portion of it, has or will have been submitted to the
electors of the County for a period of more than six months prior to the date
of election hereinafter provided; and
WHEREAS, the “Dickinson County News” is a
legal newspaper, printed wholly in the English language, as defined by Section
618.3 of the Code of Iowa, and are published in said County and of general
circulation therein.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD
OF SUPERVISORS OF THE COUNTY OF DICKINSON, IOWA:
Section 1. That there is hereby called a special county election on Tuesday,
the 3-th day of September, 2003, at which election there shall be submitted to
the registered voters of said County the following question, to-wit:
“Shall the County of Dickinson, State of
Iowa, be authorized to construct and equip a totally new Courthouse and jail
facility on the present Courthouse site at a total cost not exceeding
$14,900,000 and issue its General Obligation Bonds in an amount not exceeding
$14,900,000, for that purpose?”
Section 2. That the voting place or places for said election, and the hours
the polls shall be opened and closed shall be as set out in the notice of
election, said notice to be prepared and approved by the County Commissioner of
Elections.
Section 3. That the form of the ballot to be used at said election shall be
of the type authorized by the Code of Iowa that will permit the use of
electronic counters and will be in substantially the form set forth in the
Notice of Election. That, if more than
one public measure shall be submitted to the electors at the time of the said
election, all such measure shall be printed upon one ballot.
Section 4. That the Election Board for the voting precinct or precincts
shall be appointed by the County Commissioner of Election, not less than 15
days before the date of said election.
Section 5. That the Auditor of Dickinson County, Iowa, being the County
Commissioner of Elections, is hereby directed to publish the notice of election
once in the “Dickinson County News” being a legal newspaper, printed wholly in
the English language, as defined by Section 618.3 of the Code of Iowa,
published in said County and of general circulation therein, said publications
to be not less than four clear days nor more than twenty days prior to the date
of said election.
Section 6. That the County Commissioner of Elections shall cause to be
prepared all such ballots and election registers and other supplies as may be
necessary for the proper and legal conduct of said election.
Section 7. That the Auditor is hereby directed to file a certified copy of
this Resolution in the office of the County Commissioner of Elections, which
filing shall also constitute the “written notice” to the County Commissioner of
Elections of the election date required to be given by the governing body under
the provisions of Chapter 47 of the Code of Iowa.

day of July 2003.

seconded by Jordan to approve the application of Tom Kuhlman, for a Fireworks
Display permit for August 6, 2003, for use at the Bedell Farm west side Big
Spirit Lake. All voted aye.
Discussion of the
ILLEBG grant application in the amount of $10,000 with the county match of
$1000. Moved by Allen, seconded by
Johnson to confirm the Board of Supervisors consent and to authorize the
Chairperson to sign the assurance form for the grant application. The roll was called and the vote was, AYES: Northey, Allen, Gottsche, and Johnson, with
Jordan abstaining.
County Engineer
present. Moved by Northey, seconded by
Allen to accept Project Number L-543—73-30 (Lake Park Cemetery Road) and to
authorize final payment in the amount of $18,823.63 to Wicks Construction,
Decorah, Iowa. All voted aye.
Moved by Johnson,
seconded by Jordan to approve the utility permit application from Iowa Lakes
Electric Coop for a single-phase 7200-volt underground service line to Allen
Smith on 250th Street, Section 22 of Okoboji Township. All voted aye.
The board approves
the temporary road closure for 250th Street in Okoboji Township for
the ditch excavation and shaping in conjunction with the utility work.
There was a
review of case law with Assistant County Attorney concerning fugitive dust
issues. The matter will continue to be
researched.
County Engineer
presented a proposal to change the classification of Old Hwy 276 and Peoria
Avenue, over which the county now has jurisdiction, to a Farm to Market and
Federal Aid System routes. A change in
classification would make federal and state funding available to help with
maintenance, which could up to 80 percent federal funding for maintenance. The board authorized the engineer to pursue
the reclassification request.
Dave Murphy,
representing the Dickinson County Trails Association, was present with
information on the West Big Spirit Trail project. The Association is applying for a REAP grant for funding for the
project and the crossing of Peoria Avenue will help with plans to expand the
trail along the west side of Big Spirit Lake to the Minnesota state
border. Following discussion, it was
moved by Northey, seconded by Allen to grant permission to the Dickinson County
Trails Association to place trail in the right of way of 240th
Avenue (formerly Peoria Avenue) from south edge of St. Margaret Cemetery for
approximately 50 yards to where it will cross 240th Avenue and enter
the Crosby farm property. The roll was
called, and the vote was: AYE, Northey,
Allen, Gottsche, and Johnson with Jordan abstaining.
