      Moved by Northey, seconded by Allen to appoint David Gottsche as Chairperson of the Board of Supervisors for the calendar year 2008.  All voted aye.

 

      Moved by Allen, seconded by Northey to appoint Pam Jordan as Vice-Chair of the Board of Supervisors for the calendar year 2008.  All voted aye.

 

      Moved by Allen, seconded by Northey to approve the liquor license and outdoor service area renewal application from Schnell Brothers dba Okoboji View Golf Course.  All voted aye.

 

      Moved by Allen, seconded by Jordan to approve the Sheriff’s appointment of Linda Ann Whipp as full-time employee in the communication center beginning January 3, 2008 at ah hour wage of $13.43 per hour.  All voted aye.

Moved by Allen, seconded by Johnson to appointment Pam Jordan as liaison to the Nature Center project. Motion carried.

 

County Engineer present.  Moved by Allen, seconded by Johnson to concur with the Engineer’s recommendation to approve Dickinson County compliance with the 1970 Uniform Assistance and Land Acquisition Policies Act (2008 Right of Way Assurance Statement).  All voted aye.

 

      Moved by Northey, seconded by Johnson to approve the recommendation to approve the plans for Project No. L-603 which is also known as the 6th Street Additional Culvert project located in Section Nu. 7 of Milford Township, the project will increase the drainage capacity of the Mill creek crossing and will require approval of the City of Milford, Dickinson County will fund the entire cost of the project with a letting to be set for 10:30 A.M. on February 5, 2008. Roll call vote:  Johnson-aye, Northey-aye, Allen-aye, Jordan-aye, Gottsche-nay.  Motion carried.

 

      Moved by Allen, seconded by Northey to approve and adopt the following resolution:  CONSTRUCTION EVALUATION RESOLUTION

      WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

      WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and

      WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and

      WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2008 and January 31, 2009 and submit an adopted recommendation regarding that application to the DNR; and

      WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;

      NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF DICKINSON COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304 (3).  Passed, approve, and adopted this second day of January, 2008.  All present voted aye.

 

      Board informally discussed an upcoming budget preparation timeline.
