Dickinson County Board of Supervisors

January 30, 2007

 

      Present are Supervisors Chairperson David Gottsche, Mardi Allen, Paul Johnson, Pam Jordan and Wayne Northey.

 

      Jim Golden representing the Lakes Community Land Trust present.  Mr. Golden is requesting that the County LMI (Low and Moderate Income)funds on hand and coming in from UR district projects be used  by the Land Trust as seed money to get the organization set-up and that future LMI funds be used for the administration of the agency.  The Board is not sure that the LMI funds can be used for administration and will seek legal advice before approving the release of funds.

 

      Moved by Jordan, seconded by Allen to approve the contract with Barry Lawrensen, Orange City, Iowa, for the purpose of providing specifications, consultation and preparation of bid documents for the audio visual equipment to be installed in the Dickinson County Community Room at the courthouse and to authorize the chairperson to sign said contract.  All voted aye.

 

      Moved by Allen, seconded by Jordan to approve the courthouse project Change Order No. 44 in the amount of $35,000 to provide rough carpentry work at Phase 2 hip roof fascia and provide wood blocking similar to Phase 1.  This work is to be done on a GMP(Guaranteed Maximum Price) basis of $35,000.00.  Contractor to submit record of all materials, labor and equipment required to perform work.  Any unused amount will be submitted as a cost deduct to the contract.  All voted aye.

 

      Moved by Northey, seconded by Jordan to approve the contract with Engineering Design Associates, Inc. (E.D.A., Inc.) of Sioux Center, IA for the Oak Haven Care Facility Cooling and Ventilation Retrofit and to authorize the Chairperson to sign said contract.  Roll call vote:  Johnson-nay; Jordan-aye; Allen-aye; Gottsche-aye; Northey-aye.  Motion carried.

 

      County Engineer present.  Moved by Northey, seconded by Johnson to approve the recommendation to comply with the January 10, 2007 letter from the City of Milford requesting a reduction of the speed limit on 230th Avenue from 50 mph to 35 mph, this action is requested as a result of the development near South Shore Estates and Mill Creek Subdivision.  All voted aye.

 

      Moved by Allen, seconded by Northey to approve the recommendation to approve an overhead 69Kv transmission line for Corn Belt Power along County Road N14, approximately 4 foot from the east right of way line.  The transmission line will be located between Hwy #9 and 160th Street, in Section 3 of Richland Township and will services the ethanol plant near Superior.  All voted aye.

 

      Time for public hearing on rezoning request for parts of Section 3, Okoboji Township from A-1 to R-1 Suburban Residential as requested by Laura Merry and Jeff Reinders. Moved by Allen, seconded by Gottsche to follow the recommendation of the Planning and Zoning Commission by approving the rezoning request from A-1 to R-1 by Laura Merry and Jeff Reinders for the following described property:  The westerly part of NW SE Section 3-98-37, N ½ SW SE exc tracts Section 3-98-37, the West 33.11’ of middle tract in S ½ SW SE Section 3-98-37, the E 33.11’ of middle tract in S ½ SW SE 3-98-37 and an irreg tract in N ½ SW SE 3-98-37, known as parts of Section 3, Okoboji Township. All voted aye.

 

      Time for the consideration of Ordinance No. 07-1.  There being no written or oral objections, it was moved by Northey, seconded by Allen to approve and adopt ORDINANCE NO. 07-1 AN ORDINANCE AMENDING THE DICKINSON COUNTY ZONING ORDINANCE 102 PROVIDING FOR A CHANGE IN THE CLASSIFICATION OF REAL ESTATE, FROM A-1 AGRICULTURAL DISTRICT TO R-1 SUBURBAN RESIDENTIAL DISTRICT AND AMENDING THE OFFICIAL ZONING MAP FOR DICKINSON COUNTY UNINCORPORATED AREA for the w’ly part of NW SE Section 3-98-37, N ½ SW SE exc tracts 3-98-37, the W 33.11’ of middle tract in S ½ SW SE 3-98-37, the E 33.11’ of middle trt in S ½ SW SE 3-98-37, and an irreg. trt in N ½ SW SE 3-98-37, (parts of Section 3, Okoboji Township).  All voted aye.

 

      Time for the consideration of Amendment to Zoning Ordinance 102, by adding a new article #33, Overlay District for P.M.C., Inc. Zoning Administrator Kohlhaase present with background information on the area proposed to be in the overlay district.  The intent of the P.M.C. Overlay District is to provide zoning requirements that specifically relate to P.M.C. allowed structures and uses.  At the time, P.M.C. would change from the approved principal or conditional uses allowed, this Overlay District would become null and void and the original R-4 Zoning District would be in effect.  There being no written or oral objections, hearing was closed by Chairperson.  Following discussion by the Board, it was moved by Johnson, seconded by Allen to concur with the recommendation of the Zoning Commission by amending Dickinson County Zoning Ordinance #102 as follows:  To add Article #33, P.M.C. Overlay District (complete copy of the wording on file in Zoning and Auditor offices).  All voted aye.

 

      Time for the public hearing on amending Zoning Ordinance #102 to change the wording of building, height of.  Tony Weber present and gave his thoughts to the board as to why the ordinance should be amended, in part due to the changing styles of homes in the building industry and to further define the meaning of the article.  The hearing was closed to the call of the Chairperson.  Following discussion, it was moved by Northey, seconded by Allen to concur with the recommendation of the Zoning Commission to amend Dickinson county Zoning Ordinance #102 as follows:  “Article #3 Definitions/Use Classifications; To change the wording of Building, Height of to the following:  Building, Height of:  In all cases roof height is measured from the highest finished grade at the building line to the highest portion of the roof”.  All voted aye.

 

      There being no further business presented before the Board, it was moved by Johnson, seconded by Jordan to adjourn.  All voted aye.
